Resolution approving repayment of Faught Note

RESOLUTION

WHEREAS, as a part of the assets of the Frances Sheldon Trust, The Board of Regents of the University of Nebraska has received from Olga N. Sheldon, Successor-Trustee, a note, duly endorsed, in the sum of $10,000.00, payable in payments as therein provided, signed by Carl E. Faught and Elsie E. Faught, secured by a mortgage upon the following described real estate, recorded in Book 120, Mortgages, Page 606, Dawson County, Nebraska:

The Southeast Quarter (SE1/4) of Section Thirty (30) in Township Eleven (11) North, Range Twenty-two (22) West of the 6th P.M., in Dawson County, Nebraska; and

WHEREAS, said mortgage was duly assigned to the Board of Regents by Olga N. Sheldon, Successor-Trustee, recorded in Book 119 Mortgages, Page 648, Dawson County, Nebraska; and

WHEREAS under the provisions of said promissory note, the final payment of $5,000.00 is not due until February 15, 1959; and

WHEREAS, the makers of said note desire to make payment of said note and interest in full; and

WHEREAS, under the provisions of the Last Will and Testament of Frances Sheldon, deceased, the proceeds of the trust estate and the accumulated income are required to be used by The Board of Regents of the University of Nebraska in constructing and equipping upon the downtown campus of the University of Nebraska in Lincoln, a gallery for the purpose of housing paintings, sculpture and other works of art owned by the University, the Nebraska Art Association and similar collections;

NOW, THEREFORE, BE IT RESOLVED, that the Comptroller of the University of Nebraska be authorized and directed to accept payment in full for the balance due upon said note, above described, and upon payment of such balance, including interest due thereon, in full, that the Comptroller be authorized and directed to cancel said note and mark the same "Paid", and deliver said note to the makers thereof.

BE IT FURTHER RESOLVED that the President of The Board of Regents of the University of Nebraska be authorized and directed, upon the payment of said note and interest in full, to execute and deliver to the makers of said note and mortgage release thereof, and that the Assistant Corporation Secretary of the Board of Regents be authorized and directed to attest the execution of said release, and attach thereto the corporation seal of The Board of Regents of the University of Nebraska, a corporation.

Resolution accepting A. B. Sheldon Estate

It was moved by Regent Welsh, seconded by Regent Elliott, motion put to vote and carried, directing the following resolution in reference to the A. B. Sheldon estate be approved:

RESOLUTION

WHEREAS, A. B. Sheldon, late a resident of Lexington, Dawson County, Nebraska, now deceased, left a Last Will and Testament and Codicils thereto, which have been duly admitted to probate in the County Court of Dawson County, Nebraska, and

WHEREAS, under the provisions of last Will and Testament and Codicils thereto, A. B. Sheldon gave, devised and bequeathed to The Board of Regents of the University of Nebraska forty-five per cent (45%) of his estate, to be used by the Board of Regents of the University of Nebraska in conjunction with property received by said Board from the

Estate of Frances Sheldon, deceased sister of A. B. Sheldon, in constructing and equipping upon the downtown campus of the University of Nebraska in Lincoln, a gallery for the purpose of housing the collection of paintings, sculpture and other works of art owned by the University, the Nebraska Art Association and similar collections, and

WHEREAS, The Board of Regents of the University of Nebraska has received from Olga N. Sheldon, Successor-Trustee under the Last Will and Testament of Frances Sheldon, Deceased, the property of the trust estate, and is making preparations for the construction and equipping upon the downtown campus of the University in Lincoln the said gallery provided for in the Last Will and Testament of Frances Sheldon, Deceased;

NOW, THEREFORE, BE IT RESOLVED by the Board of Regents of the University of Nebraska that the Board accept, with sincere appreciation and gratitude, the generous and public-spirited gift and devise of A. B. Sheldon to The Board of Regents of the University of Nebraska.

BE IT FURTHER RESOLVED that The Board of Regents of the University of Nebraska hereby acknowledges that upon the receipt of the property of the Estate of A. B. Sheldon, Deceased, from the personal representative thereof, it will use the said property in accordance with the provisions of his Last Will and Testament and Codicils thereto and the Last Will and Testament of Frances Sheldon, Deceased.

BE IT FURTHER RESOLVED, that copies of this Resolution, certified by the Corporation Secretary or the Assistant Corporation Secretary of The Board of Regents of the University of Nebraska, be transmitted to Olga N. Sheldon, widow of A. B. Sheldon, deceased, Lexington, Nebraska, and to E. A. Cook, Jr., Attorney in the Matter of the Estate of A. B. Sheldon, Deceased, Lexington, Nebraska.

BE IT FURTHER RESOLVED, that a copy of this Resolution certified by the Corporation Secretary or Assistant Corporation Secretary of The Board of Regents of the University of Nebraska, be transmitted to E. A. Cook, Jr., Attorney at Law, Lexington, Nebraska, for filing in the probate proceedings in the Matter of the Estate of A. B. Sheldon, Deceased, pending in the County Court of Dawson County, Nebraska.

It was moved by Regent Greenberg, seconded by Regent Swanson, motion put to vote and carried, directing the following resolution in reference to the A. B. Sheldon estate be approved:

John K. Selleck and Joseph Soshnik authorized to receive assets in behalf of University

RESOLUTION

WHEREAS, A. B. Sheldon, a resident of Lexington, Nebraska, died leaving a Last Will and Testament, under the provisions of which The Board of Regents of the University of Nebraska is a beneficiary, and

WHEREAS, Olga N. Sheldon, as executrix of the Estate of A. B. Sheldon, deceased, contemplates obtaining an order from the court, having jurisdiction of said probate proceedings, to make a partial distribution of income of said estate, and

WHEREAS, it is desired that The Board of Regents of the University of Nebraska designate a person or persons qualified to receive such distribution and to receipt therefor in behalf of The Board of Regents of the University of Nebraska;

NOW THEREFORE, BE IT RESOLVED that upon the making of such distribution to The Board of Regents of the University of Nebrska from the income of said estate, that John K. Selleck, Corporation Secretary of The Board of Regents of the University of Nebraska, or Joseph Soshnik, Assistant Corporation Secretary of The Board of Regents of the University of Nebrska, be and either of them are hereby empowered and authorized to receive any distribution made by the executrix of the Estate of A. B. Sheldon, deceased, for The Board of

Refund In Absentia Fee to Derryl D. Ogden

From Derryl D. Ogden comes a request for a refund of the In Absentia fee paid by Mr. Ogden because of non-attendance at the Commencement program on June 7, 1958. Mr Ogden is requesting this refund because of the fact that he is a Seventh Day Adventist and in that Commencement was held on a Saturday, he desires to be excused.

It was moved by Regent Elliottt, seconded by Regent Greenberg, motion put to vote and carried, directing that the $10.00 In Absentia fee paid by Mr. Derryl D. Ogden because of non-attendance at the June 7 Commencement be refunded.

Easement granted to San. Dist.No. 1 - Ag.College

From the Business Manager, Mr. Carl A. Donaldson, comes an Easement granting to the Sanitary District No. 1 of Lancaster County, Nebraska, a perpetual right-of-way over and across a tract of land owned by the University of Nebraska directly north of the College of Agriculture main campus between 36th Street and 48th Street. This Easement is required in connection with the proposed relocation of Dead Man's Run in this area.

It was moved by Regent Swanson, seconded by Regent Welsh, motion put to vote and carrried, directing the president and corporation secretary of the Board of Regents shall be authorized to sign in behalf of the Board an Easement to Sanitary District No. 1 of Lancaster County, Nebraska, covering a proposed right-of-way for Dead Man's Run on the north edge of the College of Agriculture campus.

Schaumberg & Freeman authorized to prepare plans for remodeling of Elgin Plant

From the Business Manager, Mr. Carl A. Donaldson, comes a recommendation that the architectural firm of Schaumberg & Freeman, of Lincoln, be employed for services rquired in connection with the remodeling, reconditioning and refurbishing of the Elgin plant as recently purchased by the University for general university classroom and laboratory uses. It is proposed that this contract be made on a preliminary basis for the primary studies and first units of construction at a fee to the architect of 4 1/2% for completed plans and specifications and 1 1/2% for inspection during construction.

It was moved by Regent Swanson, seconded by Regent Welsh, motion put to vote and carried, directing the architectural firm of Schaumberg & Freeman, of Lincoln, Nebraska, be employed to prepare plans and specifications for the remodeling of the Elgin plant for use by the University of Nebraska for classrooms and laboratory purposes.

Assign copyright to Dr. Ruth M. Leverton

From Dr. Ruth M. Leverton comes a request to assign to her the copyright for the book which she authored "Food Becomes You." This book was printed under a contract with the author by the University Press. The book is now out of print and the University Press does not desire to reprint.

It was moved by Regent Greenberg, seconded by Regent Foote, motion put to vote and carried, directing assignment of copyright for the book "Food Becomes You" to Dr. Ruth M. Leverton, author.

Waive nepotism rule

It was moved by Regent Foote, seconded by Regent Welsh, that the nepotism rule be waived in the case of John and Wayne Burbank, brothers, who are serving as county agents in Antelope and Merrick Counties, respectively.

Renew agreement with State Aeronautics Dept. for serial research

It was moved by Regent Foote, seconded by Regent Greenberg, motion put to vote and carried, directing the president and corporation secretary of the Board of Regents shall be authorized to sign in behalf of the Board, a Memorandum of Agreement with the Department of Aeronautics, State of Nebraska, wherein the Department of Aeronautics furnishes the sum of $12,000.00 for the purpose of continuing a research grant to the University to be used in the investigation of the use of airplanes in agriculture to apply fertilizer and seed and the application of agricultural chemicals to control weeds, insects and plant diseases.

Profs. Meadows and Palmer permitted to engage in news broadcasting on FM Station

It was moved by Regent Welsh, seconded by Regent Elliott, motion put to vote and carried, directing the request of Dean Militzer of the College of Arts and Sciences be approved wherein Professor Paul Meadows be permitted to engage in news broadcasting for a local radio station. A similar request has been received from Dean Earl S. Fullbrook of the College of Business Administration, to permit Professor E. Z. Palmer to engage in news broadcasting for the same local radio station. Permission was granted, it being understood, however, that Professor Meadows and Professor Palmer will not be reported as being affiliated with the University of Nebraska or in any way indicate that they are representing the University of Nebraska.

Regents Bookstore named "University Bookstore."

It was moved by Regent Elliott, seconded by Regent Swanson, motion put to vote and carried, directing the student bookstore operated by the University be officially named "University Bookstore."

Permit erection of storage drying building at Scotts Bluff Exp.Sta.

From the Dean of the College of Agriculture, W. V. Lambert, comes an Agreement pertaining to a storage drying building to be erected by the B & C Corporation and the Rolfes Grain Aeration Company. It was stated by Dean Lambert that it is the desire of these companies to erect this building at the Scotts Bluff Experiment Station for the purpose of conducting experiments in forced air drying of farm crops grown at the Station.

It was moved by Regent Greenberg, seconded by Regent Welsh, motion put to vote and carried, directing the president and corporation secretary of the Board of Regents be authorized to sign in behalf of the Board an agreement with the B & C Steel Corporation and the Rolfes Grain Aeration Company for the erection of a building on the Scotts Bluff Experiment Station.

Approve addition to F. M. Hall Art Collection

Approval was given to the recommendation of the Director of the University Art Galleries that a number of art objects be purchased for the F. M. Hall Collection. This involves the purchase of 12 photographs from the Weyhe Gallery, New York City, in the amount of $300.00 All have been approved in accordance with the practice of having purchases reviewed by authorities in the field of art. Funds are available under the stipulations providing for the Hall Art Collection. Motion for approval was made by Regent Swanson, seconded by Regent Welsh, put to vote and carried.

Accept research and training grants

It was moved by Regent Swanson, seconded by Regent Greenberg, motion put to vote and carried (Regent Foote not voting), directing that the following Research Grants, Training Grants and Fellowships be accepted:

Research Grants

$1,000 from the Nebraska Heart Association for research by Dr. Loyal C. Payne of the Department of Animal Pathology: Cardiovascular studies in swine.

$1,000 from the Nebraska Heart Association for research by Dr. George A. Young of the Department of Animal Pathology: Miniature Pigs for Medical Research.

$5,000 from The Rockefeller Foundation for research by Dr. J. H. Lonnquist and Dr. C. O. Gardner of the Department of Agronomy: The effects of linkage on estimates of degree of dominance of genes determining quantitative characters in corn.

$1,000 from Great Western Sugar Company through the University of Nebraska Foundation for research by Dr. M. L. Schuster of the Department of Plant Pathology; Root rots and other diseases of sugar beets. (Continuation)
