The State of Nebraska -vs Monday McFarland and Mary Sheedy.

833-C-I65 Information for Murder in the First Degree and Accessories thereto before the Fact

Now on this day again came the County Attorney on behalf of the State of Nebraska, and the said defendants were brought into Court in the custody of the Sheriff, attended by their counsel, respectively, and the County Attorney now on behalf of the State of Nebraska, and the said defendants by their counsel respectively, each announcing themselves ready to proceed with the trial of this case, the Court orders the Clerk to call the names of the persons constituting the Jury in this case, and thereupon came the said Jury in the charge of WB Taylor, the bailiff in whose charge they were left at the adjournment of Court of yesterday, and each responds to his name as the same is called by the Clerk and takes his seat in the Jury Box.

And thereupon the trial of this cause proceeded, and after hearing the reamining argument of counsel, the said Jury are duly instructed by the Court, and retire to their room in chare of W B Taylor, a bailiff of this court, who was specially sworn to take charge of said Jury, during their delibrations, in the manner provided by law, to consider of their verdict.

JOURNAL ENTRY

That on the 29th day of May 1891, (that being the 94th day of the February A D 1891 term ofsaid Court,) were had and done the following proceedings herein as appears upon Court Journal "W" at Page 95, to-wit:

Now on this day again came the County Attorney on behalf of the State of Nebraska, and the said defendants were brought into Court in the custody of the Sheriff, attended by their counsel respectively, and now come the Jury heretofore impanelled and sworn in this case, in charge of W B Taylor, the bailiff in whose charge they were left at the adjournment of this Court of yesterday, with their verdict in writing signed by their foreman, and say:-

The State of Nebraska, Lancaster County.

February Term, A D 1891. ss: to-wit: May 29th, 1891.

The State of Nebraska, Plaintiff -vs Monday McFarland and Mary Sheedy, - - - - - - -Defendants.

We, the Jury duly impanelled and sworn in the above entitled cause, do find the defendants, Monday McFarland and Mary Sheedy, not guilty as they stand charged in the Information. John Robertson, Foreman. And thereupon it is ordered that the said defendants be, and they hereby are discharged from further custody.

MOTION

The State of Nebraska, Lancaster County.

ss: In the District Court.

The State of Nebraska, -vs- Monday McFarland and Mary Sheedy.

On Information for Murder 1st Degree.

Now comes Jas E Philpott, one of the Attorneys heretofore appointed by this Court for the defense of Monday McFarland, one of said defendants, and moves the Court for an allowance as attorney's fees for his services as such attorney, such sum as the said Court may deem just and reasonable. man in every suspect capable of providing suitable mantinance and support for the said plaintiff that during this cohabilation as hhusband and wife he failed and [?] to provide suitable food and cothing for the said plaintiff spending his money in gambling and supporting, and [dining?]. the [time?] said plaintiff in the summer of 1881 was visiting her people in Illinois. the said defendant was living and cohabiting with [?] a portion of the time, in said City of Lincoln with a common of ill [?].

That at one time [?] the cohabitation aforward the said plaintiff in order to obtain food and clothing and was of ligid o labor as a servant girl at the Arlington Hotel in said city, and at another tie when sick he was for a long time defendant for food upon the charity of the his neighbors.
