Before me W J Houston one of the
magistrates [?] and for Lancaster
County, to wit. the Police Judge of the City
of Lincoln. Personally cause Samuel
Melick who being by me first duly sworn
depases and says. That Monday Mc
Farland on or about the 11th day of Jan
uary A D 1891 in the County of Lancaster
and State of Nebraska, and within the
corporate limits of said city of Lincoln
moved upon one John Sheedy then and
there being unlawfully, purposely felon
iously and of his deliberate and premed-
itated malice did make an assault with
the intent kill, the said John Sheedy, un-
lawfully feloniously, purposely and
of deliberate and premeditated malice
to kill and murder, and [?] he the said
Monday McFarland with a certain steel
rod. wound with leather and commonly
called a cane, which he the said Monday
McFarland then and there in both his
hands then and there had and held, the
said John Sheedy, [? ?] upon the head,
of him the said John Sheedy, then and
there unlawfully, purposely feloniously
and of his deliberate and premediated
malice did strike and wound with the
intent aforesaid, thereby then and there
