SHEEDY AND MONDAY FILE MOTIONS To Quash the Indictments on Account of Some Very Careless Irregularity John Melchart's Case Against His Step-Father for Damages - No Motion Docket To-Day - The Call for Monday Answer and Motions Filed There was not a case filed in the office of the district court yesterday. The only answer filed was in the case of Jerome Williamson vs. Emma C. Williamson. In her answer she denies each and every allegation set forth by the plaintiff in his petition. She also claims that on December 4, 1889, they entered into an agreement to live apart and she was to receive $25 a month for maintenance of their three children and that he has failed to provide said maintenance. She therefore asks for divorce and alimony and the ca e and custody of their minor children. Before Judge and Jury The jury in the case of C. E. Montgomery vs. S. J. Odell brought in a verdict yesterday morning finding the right of possession of property in dispute in the plaintiff, assessing his damages in the premises of 1 cent and finding the value of the property in dispute to be $750 and the value of the right of the plaintiff to be $319.15. All day yesterday was consumed in the cause of John L. Melchart, a minor. by Katie Wohlenberg, his mother, vs. Frederick Wohlenberg. Judge Pond and L.C. Burr appeared for the plaintiff and C. L. Hall and E.P. Holmes for the defendant. This is an action for damages. The plaintiff claims that, in the year 1882 his step-father, Wohlenberg, threw him down on the floor and kicked him in the side, thereby inflicting on him permanent injuries. The defendant denies that he at any time inflicted said injuries. At 6 o'clock the court adjourned until this morning at 9:30, when the case will be continued. Mations were filed yesterday by Messrs. Sterans & Strode in behalf of Mary Sheedy and by Messrs. Billingsley and Philpott in behalf of Monday McFarland to quash the indictment pending against them for the murder of John Sheedy. The grounds for the motions are: The offense charged is not the same as that mentioned in the warrants for the arrests: second, the defendants have had no preliminary examination on the charges set forth in the indictment, nor have they waived such preliminary examination.
