TO the Hon. A. W. Field, judge of the said court.
We the undersigned attorneys of the bar of Lancaster County, at the request of Messers. Billingsley and Philpott, and disavowing any intent on our part to dictate, or interfere with the duty imposed on you to fix the amount to be allowed by you to them for their services in said case, and knowing that the statutes leave the matter to your discretion in cases of homicide, do at their request state to you that we think their services are worth, as rendered in said case, the sum set opposite our respective names.
The said attorneys after being appointed for McFarlands defense beside attending court to hear and argue motions, demurres &c, tried the case for twenty three days including the day the verdict was rendered. The case was one of more than ordinary importance.

We, the Jury duly impaneled and sworn in the above entitled cause, do find the defendants Monday McFarland and Mary Sheedy not guilty as they stand charged in the Information.

Before me W J Houston one of the magistrates [?] and for Lancaster County, to wit. the Police Judge of the City of Lincoln. Personally cause Samuel Melick who being by me first duly sworn depases and says. That Monday Mc Farland on or about the 11th day of Jan uary A D 1891 in the County of Lancaster and State of Nebraska, and within the corporate limits of said city of Lincoln moved upon one John Sheedy then and there being unlawfully, purposely felon iously and of his deliberate and premed itated malice did make an assault with the intent kill, the said John Sheedy, un lawfully feloniously, purposely and of deliberate and premeditated malice to kill and murder, and [?] he the said Monday McFarland with a certain steel rod. wound with leather and commonly called a cane, which he the said Monday McFarland then and there in both his hands then and there had and held, the said John Sheedy, [? ?] upon the head, of him the said John Sheedy, then and there unlawfully, purposely feloniously and of his deliberate and premediated malice did strike and wound with the intent aforesaid, thereby then and there with the steel rod wound with leather

and commonly called a cane, aforesaid by the stroke aforesaid, in the manner aforesaid on and upon the head of him the said John Sheedy, giving to him the said John Sheedy one mortal wound of the length of three inches and of the depth of one inch, of which mortal wound the said John Sheedy did then and there languish, and languishing did live until the 12th day of January A D 1891 on which said 12th day of January A D 1891 he the said John Sheedy in said city of Lincoln in said County, of said mortal wound, died. and officiant further says that before said murder and felony were committed by said Monday McFarland, to wit on the 10th day of January A D 1891, Mary Sheedy and Harry Walstrom unlawfully purposely and feloniously and of their deliberate and premeditated malice did procure, incite, abet, and aid the said Monday McFarland in the perpetuation and commission of said murder and felony, in the aforesaid manner, form time and place, contrary to the form of the statutes in such cases made and provided and against the peace and dignity of the State of Nebraska.
